Why exact phrasing is legally mandatory
Under § 53.284, a Texas mechanic's lien claim can only be waived or released using a written waiver that follows the statutorily prescribed form. Courts have upheld this strict-compliance rule: a homemade or generic release that omits the required notice language ("NOTICE: THIS DOCUMENT WAIVES…") or the specified conditional/unconditional structure will not extinguish the underlying lien rights.
